WHAT IS SMUGGLING?


What is Smuggling? Import-Export is the backbone of our country. There are two laws discrete. (1)The Law for men. (2)The Law for things. When things are exported there is Export duty to pay before sending goods to a foreign country. When anything is imported from any foreign country, there is import duty to pay. Customs duty is thus chargeable on (2) above.Law for things that is-goods. Any act or omission for goods liable for confiscation under Custom Act is Smuggling. Goods include Vessels Aircraft and Vehicles, Baggage, currency, negotiable instruments, any other kind of movable property. Movable property includes chattel. (1). Illegally bringing into India a boat load of refugees is Not an act of Smuggling. It relates to (1).Law for Men. Immigration. (2). Illegally bringing into India a boat load of horses is an act of Smuggling. Horses are chattel. Horses are covered under Chapter I. of Customs Tariff. (3). Illegally bringing into India US $ 20,000 is an act of Smuggling, currency being goods as listed above. (4). Illegally taking out of India,Antiques rare painting, Rare coins is smuggling as they are goods as stated above.

WINSTON CHURCHILL SERVED IN BANGLORE AS ARMY MAN.


The Great Winston Churchill was a Second Lieutenant in British Army at a salary of 450 sterling,posted at Banglore. WINSTON CHURCHILL. (1874 to 1965.) He saw military action in India. He was a good polo-player. He was transferred and served in India in 1896 to 98 end, to fight the Afghan war. He was a second Lieutenant. He was responsible for Afghan war where his squad was made to retreat. He was thereafter posted in the South Regiment at Bangalore. It is over 60 years that British army rolled out of Bangalore cantonment but the city and especially the Russell market still remembers Churchill. It is popularly said that a thousand VIPs have come and gone but the one Bangalore remembers best is Churchill who lived in winding lanes of Langford gardens. A home owner has a yellowed receipt which shows one Kasam tailor to W.Kurtill esq. for Rs. 4 towards the cost of tailoring a pair of breeches. (name is not properly spelled due to native illiteracy.) Churchill did live in Bangalore is beyond doubt. The proof lies in the moth eaten records of United services club. There is a remark : “Lieutenant W.L.S. Churchill is not to be permitted to sign chits anymore, having defaulted in making his payments to the club.” A princely sum of Rs.13 due from him has remained unpaid till this date.

RISK FACTOR Take some risk also. Without risk one can not make first million in life. It needs calculated risk to make first million in life. From a million to make a billion is not hard in life. Ram, Sam were friends from childhood to college days. Ram was a ranker, a topper. Ram is a district collector at 35, a IAS officer. Sam the other one, an average boy with a lot of common sense,he has set forth on his first world journey. Seeing places is a practical education. Some smartness helps to make money. In Paris, Sam read a classified “ attention contractors to remove junk from warehouse.” It was warehouse of a film studio. Film director had ordered to dump/throw the goods and wanted vacant space the same day. Sam saw it was 1000 tons of costly art paper. He paid for contractors for shipment and arranged to send it to Bombay. He shortened his trip and returned to Bombay.His job was to find purchasers. When his consignment docked at Bombay port, to his bad luck, what was junk in Paris, was assessed as imported art paper by Customs man in India. Sam was charged 100% import duty. Despite all the unforeseen payments, he made a million. He was thereafter busy on his way to make a billion. As against this, his friend Ram is very busy, 24/7 a week. He is busy paying car installment and house installments.

KNOW THE SYMPTOMS OF A HEART ATTACK.


A MILLION A YEAR DIE OUT OF HEART ATTACK IN INDIA. KNOW THE SIGNS OF HEART ATTACK. The heart is in the center of the chest. It is not on the left as claimed. You feel discomfort in the center, under the neck-tie. It is not always a sharp jabbing pain. It is a sensation of pressure, weight, squeezing and aching. Discomfort may radiate through the center or whole chest area. It may subside in a few minutes, or hours to return later. Distress may extend from chest to one or both arms. Do not mistake it as arthritis. Raise your arms above your head, arthritis pain will aggravate. Pain due to heart attack will not aggravate. It will spread to the neck and the jaws. Do not mistake it as toothache, arthritis or stiff neck. Pain may appear upper abdomen. Do not mistake it as indigestion. Spray NG under the tongue, Nitro-Glycerin spray. You are saved. It is advisable to keep NG spray,or tablet handy in the house. You must find it when you need it.

INDIAN CIVIL SERVICE EXAMS AND THE UPSC.


INDIAN CIVIL SERVICE. The President rules the country. The PM governs the country. The Civil Service administers the country. A coterie of civil service official forms the PMOs office, and the secretariat run the administration of the country. It is therefore necessary that gem of the country’s intelligentsia may be selected by the UPSC. In reality the situation is exactly the opposite. Readers may remember that last year with the change in the Government in June 2014 the UPSC cancelled the entire process of recruitment and selection in final stage on flimsy ground of the Hindi Speaking candidate representation etc. Anybody can put two and two together and come to the figure four, that is the new ruling party wants his people in the list. Before appointment to such posts, there should be thorough scrutiny of antecedents. Integrity, merits have to be considered and evaluated for such posts. Transparency in selection is a must. The impact of the deeds/misdeeds of such civil servants affect the interest of a billion people. “May the pen of the civil servants may not ruin what the country attained with great exertions.” They have to be true spokesmen of the policy of the Government.

THE HEIGHT OF ABSENTMINDEDNESS-an Illustration.


The Height of absent-mindedness. This attitude is seen among artists writers and celebrities. They are involved in their own world of ideas and whims. They eat drink mechanically. Their mind is traveling elsewhere. Teaching a Fish to Swim. How would you feel in such a position? My friend Mary was returning to India from a long stay in USA. She found herself some time to spend at Heathrow airport. She bought a cup of coffee and a small pack of biscuits. She staggered laden with luggage to an unoccupied table. She was reading when she felt aware of some rustling at her table. From behind her paper she saw a neatly dressed young man helping himself with her biscuits. She not wanting to make a scene,leaned across and took one for herself. A minute or so passed. More rustling. He was enjoying a second biscuit. By the time they were down to the last piece, she was real angry. She could not bring herself to say anything, out of embarrassment. Then the young man broke the remaining last biscuit into two, passed half across to her. He ate the other half. He then left leisurely. She was fuming all the while,quite red. When the desk-team asked her for boarding pass. Imagine her state of mind when she opened her handbag. Her biscuit packet was lying there mocking at her. She exclaimed “Oh No!

ALL THEY NEEDED WAS A CELLPHONE INTERNET COMPUTER AND A CAR. THE WORLD IS IN THE POCKET OF INDIAN YOUTH. THE INDIAN YOUTH HAS TO SCALE THE SEAS AS INDIA HAS A LARGE COAST-LINE. THEY ARE BOLD FEARLESS DEVILS. VACATE THE PLACES AND GIVE THEM A CHANCE, SOONER THE BETTER. EXPLOIT THE INTERNET. THE CELL-PHONE IS YOUR 
SECRETARY. THE MODERN AMENITIES HAVE CHANGED THE WORLD. We were mentally poor. We have to come out of this poor mentality. Even Anil has this defect. Both these brothers have studied at Wharton but have not come out of it. We suffer from inferiority complex. In the pre-independence days brainless 25 year Boys of Britain ruled over India. Indian Kings and all used to fall at their feet for favours. England is just like say one of our states in area. These Britain Boys arrived in the docks of Bombay at an age of 18, to rule. There was no place for them in England. It was all filled up with progeny of Lords and all big dignitaries. These young boys were given a chance to prove their ability. They gave vent to their whims and imagination. They were about 3000 ICS officers and 20,000 army personnel as officers. The field and clerical staff etc were recruited from within the country. The soldiers were also recruited from within the country. Battalions were put under charge of British army officers through out the country. They represented challenge, adventure and found the fulfilment of dreams. This was denied by their country because of their limited resources. These 23000 fellows governed the length and breadth of Greater India. These fellows emptied the treasures of India. They organized to send ship loads of opium tea, antiques, jewels, gold etc. The returning ships brought cigarettes, whisky, textiles etc. to sell in India.

THE COMMON MAN AND THE SPIRALING PRICES.


Spiraling Prices and Common Man. “Misery acquaints people with strange bed-fellows.” ManMohan Singh was then in the Planning Commission. It was in the year 1983. He was in the lawns of Circuit House. I asked him. I :- “Today the rupee is worth 22 paise, a Rupee. What happens when rupee will be zero paise a Rupee? He looked at me if it was the silliest question he was asked. With his hand on his beard, and a cup of tea in the other, he replied. ManMohan: “Nothing happens.” “The Unit will be two rupees.” “It will be two rupees worth hundred paise and so on.” He was unmoved with the falling of the unit of currency, the rupee. Today the unit of currency is ten rupees worth a hundred paise. The rulers do not bother. It is taken as a natural phenomenon. The downfall of the unit of currency has taken a toll of the common man. Sugar is sold at Rs.40. In Morarji’s time it was Re1.75 a kg. in 1978. The Agriculture Minister is the Sugar King. He is responsible for the rise in prices of agricultural commodities. Food items are the basics for a population of a billion. There is an all round increase of prices in all fields. Government raises their hands in helplessness. Then what for the government is if it can not address basic ill of the country?

In practical life something more than just grades is required. It is your guts, insight, audacity bravado daring way that counts. It is not important how much money you make in life. It is important how much money you keep in your life. We come across cases of stock market winners who were poor. Suddenly stock market winners become rich, then poor again. They win millions and were soon back to where they began. If you want to be rich you should be financially literate. You have to lay emphasis on the art of mastering financial literacy. You have to have a solid foundation of financial insight into it. One has to master the art to learn the intricacies of financial trend. The words assets and liability makes sense only to an accountant. Asset is your capital having commercial or exchange value. Liability is the claim on your assets. In actual life definition of asset is in numbers. What defines an asset is not words but numbers. If you cannot read the numbers, you cannot tell an asset. It is called the need of learning the art of comprehension. Therefore the successful ones acquire assets and we acquire liabilities. Asset is something that puts money in my pocket. Liability is something that takes money out of my pocket. Therefore you have to master the art to buy asset and not liability If you are having difficulty in your business, you are not reading numbers. To be rich and to stay rich, you have to be financially literate in numbers. You have to monitor the cash-flow like a flow of drinking water in a cistern. Profit and loss measures income and expenses. You do not work for money but money works for you.

Opportunities in Life. During his life-span man comes across opportunity. He has to be alert or receptive to grab the opportunity. No man can climb the ladder to success without a basis. An opportunity in life gives you the basis for a successful life. Many men have been seen grumbling about having no opportunity. Many men wait for opportunity happen to them in their life. Everyman’s innermost desire is for something to happen. They turn a despairing gaze over the solitude of their life, seeking some white sail in the masts of horizon of life. But nothing happens. They have been saying that God had willed it so. To them their future is a dark corridor with its door closed. What you have to fear is fear itself. You are afraid of the insecurity of life. You do not take an initiative or risk in life. Take a lesson from the life-style of others. Give yourself a position not less than that of Anil. Try to respect your self first and foremost. Behave like Anil. Anil is no God. He had a handle, Dhirubhai was his handle. Create a handle. Life is easy. Do not wander about here and there aimlessly. Take a tour of the country. See everything. You will find your way.

SILENCE IS GOLDEN.


Importance of Observing Silence. “Mahatma Gandhi during his lifetime, observed Monday as the day of his observing silence. He spoke nothing at all for one day and observed silence. He believed that keeping himself silent was a way to bring order to the Mind.” If circumstances required the Mahatma to convey something, he would write it on a paper. No talking for 24 hours is an impossible job unless one has an iron will and steel determination to observe silence. No talking is extra hard for regular people who are talkative. People are seen to talk about almost anything and everything, Including baseball, basketball, cricket, music, movies, politics and anything under the sky. In reality, if one has to shut up for five minutes, it is very difficult, if not impossible. You will feel the top of your head about to explode. People keep talking for the sake of talking so that their presence may be felt. He feels by talking he is in charge of the situation. It is sort of like behaving like a police officer out in the middle of the traffic. After passing a full day of silence, your mind will enable you to speak the right words. Your small words uttered in a routine way will sound to others as orders. Every word you speak counts. Choose power words. Singing is not talking. We can sing together. We can not talk together. Silence is golden. Silence is eloquent. Too much of talking drives the other people crazy. Do we call ourselves civilized? We would project as a miserable aimless directionless mob. When we are together in a procession, we do not shout, wave, yell and hoot at friends who are passer-by. At a meeting we do not whisper and giggle and point out and wave and laugh at our silly jokes. And when we are together at the lunch table, it is not free-for-all festival to blab. Lunch is a time to sit and be quiet and eat.

SCRAP-SHIPS


SHIP BREAKING YARDS. At the end of their sailing life, ships vessels and floating structures are sold as scrap for their steel. Greece is the place where auction of such ships takes place. A ship for breaking is sold ordinarily between two to five million US dollars. The Principal purchaser are generally shaikhs in Dubai. They buy such ships for ship-breaking, making payment in US dollars. Such ships are sent to ship-breaking yards-say Alang ship-breaking yard, Bombay, Sachana etc. In India they have their syndicate in New Delhi runs this business. The Syndicate pays the Principal in kind by exporting equivalent valued foodstuff butter cheese,grains pulses-in short everything as indented by the Principal. After fulfilling customs formalities ship-breaking takes place in under-developed countries Bangladesh, Pakistan India China etc. Such ship breaking activity turns our green good sea-beach into dirty graveyards. Such ships brought for ship-breaking also contain hazardous material like asbestos lead paint,PCBs (poly-chlorinated biphenyls) in engine oils. During the process of scrapping hazardous poisonous gas is found released in the environment. Every year about 700 such ship are taken out of actual sea-faring and put into auction for scrapping. About 300 such ships account for our share in ship-breaking approximately. Such ships ordinarily travel under flag of convenience available at cheap rates from countries like Panama, Malta Cyprus etc. Ship masters have the right to sail under any flag they choose. Ships are registered in such countries where rules are not strict. Shipping companies and ship-owners remain incognitio -their origin can not be traced. Everything is done by petty contractors middlemen etc. They make huge profits from selling such old ships but do not bear the burden of undertaking a follow-up clean break-up of the ship. Here they raise their hands. The International Maritime Organization has issued clear cut guidelines for follow up action till completion of the breaking process by the sellers of such old vessels. In our country, the Honorable Apex Court of India rendered yeoman's service by issuing guidelines on lines of the IMO plus the Lordships have also issued directives that prevents dumping of hazardous wastes in the country, and the ship has also to be delivered with 'gas free for hot works' certificate as per Indian Laws. Their Lordships have stressed that the Basel Convention was applicable to export of such ships to our country as it amounts to one and the same thing like export of hazardous materials to our country; and that 'gas-free for hot work' should be made compulsery for the ship owner and that no ship be given permission to beach unless such certificate is produced. Any explosion irrespective of the certificate should result in cancellation of the plot holder's license and the Explosives Inspector prosecuted. The Pollution Control Board has issued instructions to observe the said precautions. It has also directed to remove asbestos and other hazardous waste on board of the ship and store it at a landfill in the hinterlands adjacent to the ship-breaking yards. This directive is uncalled for as it does not address the illegalities of import of such hazardous wastes into the ship-breaking yards. Many agencies have visited the ship-breaking yards of Alang, Bombay to monitor environmental pollution. Syndicates have very long hands and everything has remained on paper. There is complete ban on diamond polishing in the western countries being hazardous to health. They send all their diamonds for trimming polishing shining to underdeveloped countries. There is complete ban on manufacture of synthetic organic dyestuffs being hazardous to the environment. Such SODyes are manufactured in India. They import it from India. Pollution Control Board and Courts have issued innumerable guidelines but they are of no avail. Time is now ripe for public awakening. At a little distance from Alang, at Pipavav, the Japan Car manufacturing company financed the Delhi syndicate for establishing a modern ship breaking yard. This ship-breaking yard is now ready but it is delayed for want of last minute green signal from the Government. As per arrangement, every year Japan renders 200 vessels for scrapping. These vessels would be scrapped at Pipavav. The cut steel would go Japan for use in their automobile plants. This arrangement was done during the earlier regime between 1985 to 90. Now that this party has come to power, it will be shortly commissioned. In short it is time now to enforce the directives issued by the Honorable Supreme Court of India. In Japan their Government have refused permission to establish a ship-breaking yard in Japan sea-waters. India welcomes everything. This state of affairs has to stop now.

ENORMOUS SCOPE OF MEDICAL TOURISM IN INDIA.


MEDICAL TREATMENT IN INDIA. There was a time when you could run a clinic with a doctor and one nurse. But the urban healthcare has undergone such a huge change that the earlier scenario might sound straight from the middle ages. The high-end hospitals are run more like luxury hotels and offer quality treatment. This coupled with cutting-edge research has ensured a plethora of job opportunities for the aspirants. So while the investment bankers or software engineers were left grappling with the pink slips this year, healthcare not only grew but continued spawning many industries. Healthcare IT, health insurance, hospital management, pharmaceutical, medical devices to medical tourism are just some of them. "There are four factors changing the face of medicine - corporatization, availability of high end technology, rise of medical insurance and rigorous government initiatives in the rural India," Currently it is estimated to be a USD 35 billion industry, it is expected to reach USD 150 billion by 2017. While world class treatment is becoming almost a norm in high-end hospitals, the cost of treatment is still way less than the developed countries. It costs a tenth and sometimes a sixteenth of what it does in the West. Thanks to this the medical tourism is the fastest growing segment of the tourism industry. It will attract 1.1 million patients by 2015. This means that healthcare management would become a sought after area as one needs competent professionals to deal with the marketing, operational and administrative side of the high-end hospitals. The areas which are seeing maximum growth and ground-breaking research are reproductive medicine, plastic surgery, endocrinology, oncology and cardiology. Apart from this, newer specialization are also in the pipeline. Emergency service has long been a recognized specialization in the developed countries. Recently, the Medical Council of India (MCI) gave it thumbs up and colleges across India have been notified to offer it as a post graduate discipline. Geriatric medicine or the care of the elderly is another area to watch out for in the future. "While it is already in existence in countries such as USA and UK, in India it would require more attention as life expectancy is on a rise and so are the ailments associated with the elderly," While the cities seem to be getting the best of the healthcare, the government has taken initiative to address rural areas as well. In 2005, the National Rural Health Mission was launched to provide accessible, affordable and accountable quality health services to the poor in the remotest of regions. In order to attract more doctors to the peripheral areas, incentives in terms of salaries and reservation in post graduate seats are on offer. But there is a major roadblock which most aspirants have to deal with - the lack of postgraduate seats. EMERGENCY FIRST AID KIT. First Aid. What we anticipate, seldom occurs; What we least expected, generally happens. Emergencies can happen any time. It may be the house, the office or when we are in the car. We hear of unfortunate stories of accidents which could have been prevented with First Aid measures. If we know what we can do, it can save lives. Stay calm. Do not loose your patience. What you need to know is easy safety tips, first aid, supplies and awareness till help comes. Some hints may help. They are as under. Keep a first aid kit box in the house and one in the car. Use First Aid and life saving techniques, and call emergency number. Affix on the kit box important call numbers in an emergency. Remember the four B’s. Breathing. Bleeding. Broken Bones and Burns. 3. Make the home safe, against Carbon monoxide, gas leak and fire. If there is heavy bleeding from wounds, stop bleeding. Call emergency van. If there is head injuries, look for lump, wound, cut. pain or unconsciousness. Do not remove objects like glass splinters nail etc from wound. Call medical help. 4.Food poisoning. Food quality, when in doubt, throw it out. 5.Electric injuries. Make sure electric current is off before touching the victim. 6.Allergic reaction. Look for blisters, sneezing red face swelling of tongue ears face. 7.Fainting. let him sit down head between the knees. Do not give any drink. Poisoning. Blood vomit. look for container, keep it. ENGLAND- A KINGDOM WAS LOST WITH FREEDOM OF INDIA.


A kingdom was lost. Jawahar Lal Nehru. Every 14th November we celebrate Pandit Nehru’s Birthday. He was the First Prime Minister from 1947-to 1964. He was the son of Motilal Nehru. He was sent to England at 16. He stayed there for 8 years. He studied Latin, playing Cricket at Harrow. He studied science and read Canterbury Tales of Chaucer at Cambridge. He was great social success in English society. He moved easily through their drawing rooms absorbing English values and culture. So complete was his transformation that he was an English-man when he returned to India at the age of 24. Nehru applied for membership at local English Club, at Allahabad. He may have been a product of Harrow and Cambridge, but to the Club, he was an Indian and was denied admission. And that was the end of the British. This bitterness of rejection motivated him to join Congress. He accepted Gandhiji as Guru. Gandhiji would not accept him so easily. He asked Nehru to tour India and report what he saw, and his views, on all he saw. Nehru set out on a tour of the country which inspired him to write Discovery of India.

Wild Life smuggling. The Punishment is too Soft. Man Caught at Air Port with 44 Lizards in his Pants. In New Zealand. A German traveller stuffed 44 small lizards into his underwear before trying to board a flight has been sentenced to prison for plundering the country's protected species. He will spend 14 weeks behind bars and must pay a 5,000 New Zealand dollar ($3,040) fine before being deported to Germany as soon as he is released. He was caught by wildlife officials at Christchurch International Airport on South Island in December, about to board an overseas flight with 44 geckos and skinks in a hand-sewn package concealed in his underwear He admitted trading in exploited species without a permit and hunting absolutely protected wildlife without authority, pleading guilty to two charges under the Wildlife Act and five under the Trade in Endangered Species Act. He could have faced maximum penalty of NZ$500,000 ($355,000) and six years in prison. The geckos may have been worth 2,000 euros ($2,800) each on the European market. He had also been to New Zealand in 2001, 2004, 2008, and 2009. In 2008, he had been with a Swiss reptile dealer.
